Abstract
The purpose of this article is to bring forth the
Mortgage laws in Islamic Jurisprudence and some topics
related to these, in a perceptible way, and to explain those
Articles and Sections which is in practices in Pakistani
courts in Mortgage laws, Such as The Transfer of Property
Act, 1882 and Contract Act 1872, and to compare Islamic
law of Mortgage to existing law of Mortgage, to show the
similarities and contrasts between both laws.
