Hereditary Succession in Religion and Politics: A Research View in the Light of Islamic Shariah

تلخیص
The political and religious inheritance practice in Pakistani society mostly does not comply with Shariah guidance and merits. Generally, the elder son of the political leader or religious dignitary (especially on saints’ tombs or in Madāris) is considered the successor of the seat irrespective of the fact whether he possesses prerequisite qualities to the seat or not. Usually, the appropriate and suitable persons are ignored. The Islam being an ideal code of life and a complete guidance for the Muslims orders its adherents to follow the merit or legitimacy and choose the most fit individual in such manners, but these teachings are not followed in its true spirit. The rulings and different theories of prominent scholars are presented in this study about this aspect. The research presented discusses the reasons why this violation of merit is against the standards of Shariah. The discussion brings the pros and cons of this inheritance practice in Pakistan defining the legal status and clarity about its permissibility or prohibition. The purpose of the article is to enhance the understanding of the tradition of hereditary succession in religion and politics in the light of Islamic Shariah.
