Adoption and ruling in Islamic law and its legitimate alternatives
Abstract
Adoption is one of the social phenomena prevalent in contemporary Muslim
life. It was also a common practice in pre-Islamic Arab society and other nonArab nations such as Roman and Greek. However, in the modern era, there
has been a great deal of adoption among Muslims as a result of the natural
calamities, grinding wars ending up with massacres and the fragmentation of
families. In the light of recent changes in modern life due to tremendous
scientific and technological affects emerging generations and the complexity
of their life patterns, and may cause an increasing number of illegal childrens
in some Muslim communities, besides a large number displaced children and
neglected orphans. Therefore, to adopt those children as a charity to them
with the full rights of legal children became familiar as "good deed" without
having a sound research on finding out the view point of Islamic
Jurisprudence in this regard. This study steps forward to analyze the idea of
child adoption, study the limits or prohibitions, and to provide legitimate
alternatives to solve this real- life social problem. The solutions have been
approved in Qur'an, Sunnah and the books of Islamic Jurisprudence, but it
needs contemporary diligence and legislation, so, the matter could be resolved
on best Islamic legal grounds for the in contemporary
scenario
