Abstract
In the last four decades great and universal changes occur across the whole world. Among these changes are increasing rations of divorce, living relationship and as a result the issues of children’s birth and their brought up, homosexual marriages and living alone of women after getting divorces or becoming widow. From 2010 to 2017 there is a remarkable increase in the ration of divorce in Pakistan. Almost ten thousand cases of divorce had been registered during these years in big cities of Pakistan like Karachi, Lahore, Faisal Abad and Rawalpindi. This situation is a symbol of weakness in family as an institution. Islam has provided comprehensive teachings regarding family system and also provided instructions in case of any problem and conflict. Quran teaches us to appoint two persons as arbitrator from the families of married couple who is having some conflicts. The family life is one of the aspects of teachings of Holy Prophet (PBUH) regarding social life. He not only provide us with detail instructions regarding the strength of family life but also give solutions about the conflicts. The tradition of strong marital relationship can be seen through out the Islamic history in Islamic societies. This is because of the teachings of Quran and Sunnah, the practice of Sahaba and Tabaeen, legal and constitutional instructions given by Muslim Scholars. This research article analyse and define the criteria and qualification for the people responsible for arbitration among married couples, determine their responsibilities and authorities. It also discusses the difference in their nature being rural or urban and the legal statues of their decisions. It also take into consideration, on prior bases, the analytical study for the issues and problems regarding the implementation of Quranic teachings in the establishment of legal institutions for this.
