Abstract
There are emerging latest methods for diagnosing the diseases, in the contemporary modern advance medication .By the help of these tests, the cure of many fatal diseases ,epidemics is possible ,to a large extant, of the married couples. In result, they can avoid from many complex diseases by virtue of these pre-merriage medical diagnostic tests.Owing to these tests ,they can secure from many fatal and complex diseases by knowing the medical instructions .So there lie many benefits and wisdom in these tests . As far as Islamic point of view is concerned , many Islamic scholars have rejected and discouraged these practices . They have rejected considering them against the trust in Allah almighty .Yet,the underlying purposes and wise instructions found in these tests require true and scholarly invetigation regarding the validation and justification of such pre-marriage diagnostic tests.In this regard , there would be required certain diagnostic conditions and situations which would determine their validation . If those certain conditions and situations in the couples are found,it would be valid and justified in the light of objectives of Shariah.Further, no sort of obligation on the behalf of government would be implemented as a condition for marriage .It is because of the matter of personal health conditions ,which determine doings and not-doings in Islam. As it is an importan canon in Islam. It is a rule in Islamic Jurisprudence that the Islamic instructions and orders always change with the variation of time and space or place.So variation of environmental and personal circumstances require change in the commandments,according to objectives of Shariah.In this connection, equality of observation in this sort of law,regarding pre-marriage diagnostic test,cannot be implemented equally without considering and determining the diversity of the concerns discussed above
