Abstract
This study analyses the scope for establishing human rights obligations related to access to medicines in postTRIPS Agreement arrangements. The enforcement of patents on medicines has always ignored the human rights
aspect of medicines. The World Trade Organisation (WTO), through its laws and interpretation of these laws,
has not included the human rights impact of enforcing patents on medicines. Therefore, enforcement of patents
in isolation to human rights standards creates two conflicting norms. This human rights debate of accessing
medicines have become prominent in the post-COVID era. Therefore, the paper presents a critical analysis of
the interaction between access to medicines and patents on medicines. By using the doctrinal research methods,
the study relies on the documentary analysis of legal sources to find the space for access to medicines related
human rights vis-à-vis patents on medicines.
