تلخیص
The aim and objective of this paper is to clarify that Islam has given priority to the welfare of humanity in all aspect of life, so he can handover his permissible work to another person in the base of necessity, it called agency (Wakālah). This study also explains that in Islamic Sharia has its own limits and conditions for agency. This study indicates that shari'ah not contrary investments are permissible in Islam, therefore, wakālah can be used as an investment tool, while the subject matter is known and the contract of wakālah does not contain non-Shariah matters. This study also explain that Investment Wakālah is obligatory contract between the contractors, and when the agent done his job he become entitled his wages, whether there have been gained profit or loss in the investment activity, However, if the loss gained due to the negligence of the agent, then the responsibility be make on the agent. Investment Wakālah can be used also as an alternative to a bank overdraft. Banks and other financial institutions can hire each other as an agent for the legitimate investment activity.
