Abstract
Marriage is a relationship whereby husband and wife receive spouses and afflictions, there is support for the wife and children, the woman nourishes the children with mental acuity, the child educates with peace and security. They engage in training, the husband professionally engages himself in the care of the family and is free from domestic responsibilities; if for some reason this relationship breaks down, the woman is most likely to suffer. Becomes a burden to one's own life and children cannot travel the uneven paths of life without the affection of a mother; the children feel the comfort of the mother's lap, the bed of gold is not comfortable to them. May be; therefore, if the relationship breaks down and divorce is resolved, the family is scattered and mothers and children become helpless To tackle such issues, the Shari'ah has a complete system of care and support and special exemptions are given to women and young children .According to Islamic law, it is clear that the parents raise the children together and it is also known that the mother has the right to raise the children when the spouses are separated, but how long the mother has this right. The mother has the more right to custody of her child whether boy or girl, so long as she does not re-marry. Welfare of the minor should be considered in every situation. This paper well Analyses these issues .
